  • Web surfing data

The computerized systems and software procedures which ensure the functioning of this website acquire, as part of their normal operation, some personal data from the users whose transmission is connected to the communication protocols of the Internet. Every time an user accesses our website and every time a content is displayed the access data are stored by us as controller (and by the data manager) by way of log files, made up of: site of source (containing the link to our page), IP address of the user, date and time of access, request of the client, code of http answer, size of transmitted data, browser and operating system.  Among the personal data collected during the visits of the users to our website the following elements are therefore included: IP addresses or domain names of the computers and access devices of the users, the addresses in URI/URL format of the requested resources (Uniform Resource Identifier/Locator), the timing of the requests, the method used to submit the requests to the server, the size of the answer files, the numeric code of the answers given by the server (messages of acknowledgment, error, etc.). and other info about the operational system and computer environment of the user.

The User can provide own personal data to the Company by filling in and sending the form in the website at the link https://www.imvspa.com/contacts/?lang=en: transmitting these data entails the company will acquire the address of the sender, as required to answer to the requests, and the other personal data included in the communication.

Neither user profiling cookies nor other tracking systems are used. Technical cookies are used, i.e. small text files which are stored locally in the temporary memory of the user’s browser – so in the computer – to improve the website surfing experience.   • PURPOSES OF DATA PROCESSING AND LEGAL GROUNDS

 

  • Web surfing data – the log files and the data they contain are processed by us with the following purposes:
  1. Enabling the users to access web services

(legal ground as per lett. B, comma 1st art.6 Reg EU 679/2016);

  1. Obtaining statistical information about the use of the services (most viewed pages, number of visitors for days or time slot, geographical area, etc.) as well as checking the correct operation of the website and protecting our systems, as for instance against cyber attacks.

  • VOLUNTARY NATURE OF DATA PROVIDING

The data for the purposes as per item 4, letter c) shall be transmitted optionally, voluntarily and explicitly by the Users. The failure to provide them shall have as only consequence the impossibility for the Company to pursue the specific purpose (i.e. answer to the requests of the Users).

  • DATA STORING

 

  • Web surfing data: they shall be stored for a maximum of 7 days and shall be deleted immediately after their aggregation (except when requested by the judicial authorities to investigate alleged offences).
  • Data transmitted by the user: they shall be provided voluntarily and explicitly by the users of the website by filling in and sending the form at the link https://www.imvspa.com/contacts/?lang=en to enable the Company to process and answer to the Users’ requests. In this case the data shall be stored for the required duration to provide the requested service, they shall be then stored for an additional 3 years. The duration shall be extended in case it is necessary to fulfil a legal obligation or to establish, exercise or defend a legal claim in a court proceeding;
  • Cookies and other tracking systems: the storing of the session cookies in the devices or in the browsers is under control of the user; information about cookies are stored in the service logs in the server at the end of HTTP sessions, for a maximum of 7 days as for the other web surfing data.

The recipient of the data collected from the user’s access to the website www.imvspa.com/new/ is the supplier of the developing and maintenance services of the web-based platform, appointed by the Company as Processor according to art.28 of the Regulation.

 

  1. Data manager

The collected data are also processed by the staff of the Company which acts on the grounds of explicit instructions about purposes and methods of the processing (Data protection officers or “persons who are authorised to process personal data”).

 

  • RIGHTS OF THE DATA SUBJECTS

The Data Subjects have the right to obtain from the Controller, where that is the case, access to the personal data and rectification or erasure of the same or restriction or objection to the processing (art. 15 et seq. of the Regulation). I.M.V. S.p.a. requests the users not to give information which can be classed under special categories of personal data as per art.9 of the Regulation (for inst. data referred to racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership,  sexual orientation, biometric data, data concerning health).

 

  • TRANSMISSION OF DATA CONCERNING THIRD PARTIES

 

In the event of the transmission to I.M.V. S.p.A. of not own data but third parties’, the User is the only Processor of such data, has all the legal obligation and responsibility and undertakes to release I.M.V. S.p.a. from liability in case of any complaint, claim or compensation request coming from third parties, whose data were treated in violation of the regulation about personal data protection in force.

In any case, when the User provides personal data concerning third parties, he or she guarantees that it is in compliance with this information and the third party has already given consent to the processing.

 

  • UPDATE OF THE PRIVACY POLICY

 

I.M.V. S.p.a. reserves the right to modify and/or update the content of this Privacy Policy, in part or completely, for instance because of changes in the regulation in force. The modifications to this Privacy Policy shall be binding as soon as they are published in the website, therefore the Company asks to the Users to regularly visit this Section to check the information about the processing of their data according to the most recent and up to date version.
